The Alberta government has tabled legislation to invoke the notwithstanding clause for three controversial laws that affect transgender people.

Bill 9 — the Protecting Alberta’s Children Statutes Amendment Act — proposes changes to three pieces of legislation passed last year that require parental consent for students changing their names or pronouns in schools, limit gender-affirming health-care and ban transgender girls from participating in amateur female sports.

If passed, the legislation tabled on Tuesday would invoke the use of the notwithstanding clause to prevent a court from striking down the laws for violating specific sections of the Canadian Charter of Rights and Freedoms, the Alberta Bill of Rights or the Alberta Human Rights Act.
