The family of James Comey attended a federal court hearing regarding the government's case against the former FBI director.

The Justice Department has indicted Comey on charges of making a false statement and obstructing Congress. Comey has pleaded not guilty to the charges and denied any wrongdoing.

On Wednesday, the Justice Department said the grand jury that charged Comey wasn't presented with a copy of the final indictment.

Prosecutors made the acknowledgment under questioning Wednesday from the judge overseeing the case.

Comey’s lawyers say that lapse is grounds for dismissal of the case.

The Justice Department has denied that the prosecution was vindictive or selective and insists that the allegations support the indictment.
