TOLEDO, Ohio — A man who has been in jail since 2018 after being convicted of raping his young daughter is set to go back on trial after he was granted a new one following a review of the case by Lucas County’s new conviction integrity unit.
On Monday morning, Joel Terry appeared in the courtroom of Lucas County Common Pleas Court Judge Lindsay Navarre, who granted Terry a new trial after a September hearing. Monday morning, the prosecutor’s office decided to put him back on trial.
The state was asking for Terry to be held on a $1.25 million bond, but the judge declined and gave him an own recognizance bond, and he is set to be released.
Terry was convicted at a 2019 trial of raping his daughter on multiple occasions. He was sentenced to 75 years to life and was not eligible for parole
