TUCSON, Ariz. (13 News) - The Tucson Police Department is investigating the death of a man at a convenience store.

The TPD says officers responded to the store located at 4160 N. 1st Avenue Friday morning, November 21.

Police say 46-year-old Emery Kirk was found unresponsive and taken to Banner University Medical Center in critical condition.

He died the next day.

The TPD says officers learned Kirk entered the store, went behind the counter, and started concealing packs of cigarettes from a shelf.

Police say a bystander intervened and a physical confrontation occurred between the two.

The 31-year-old male involved in the confrontation called 911 to report the incident.

The investigation has been turned over to the Homicide Unit for further review.
