SARATOGA SPRINGS - In a final ruling Wednesday, a state appellate court agreed with the Saratoga County Court decision to dismiss the indictment against Vito Caselnova, a Queensbury man accused of second-degree attempted murder after a shoot-out on Broadway and Caroline Street in 2022.
About three years ago, Caselnova, a former part-time Rutland County sheriff’s deputy, was off duty in downtown Saratoga Springs with his then-girlfriend when a verbal altercation began between Caselnova, Alex Colon and a group of individuals with Colon. The encounter escalated further when Colon and Caselnova exchanged gunfire. Caselnova, his girlfriend and Colon all sustained gunshot wounds from the exchange.
