WILLIAMSPORT — A federal judge is allowing a former Penn State basketball player one more opportunity to amend his defamation suit against the university and men’s head coach Michael Rhoades.
U.S. Middle District Judge Matthew W. Brann on Tuesday granted the defense dismissal motion but gave Kanye Clary until Dec. 16 to cure the deficiencies in his complaint.
Also dismissed with the opportunity to amend was a vicarious liability claim against Penn State.
Clary contends he was suspended and then dismissed from the team on Feb. 19, 2024, because he spoke out as captain against various injustices players faced from the coaching staff.
The judge found only two of the statements attributed to Rhoades sufficiently met the criteria for defamation, with the rest being too vague.
