OLYMPIA, Wash. — In a hearing on Tuesday the two contractors charged with second-degree manslaughter related to the fatal carbon monoxide poisoning of an Evergreen State College student, Jonathan Rodriguez, agreed to a diversion plan.

According to the terms of the plan, Frank McCutcheon and Brett McCutcheon must go three years without breaking the law, and then their charges will be lowered to a misdemeanor.

The men were the technicians who installed the water heater in early December 2023. Prosecutors have alleged that their negligent actions caused Rodriguez's death. The pair previously pled not guilty to the charges.
