A federal judge will hold a hearing today to determine whether acting U.S. Attorney John Sarcone is legitimately serving as the top federal prosecutor for 32 counties in Upstate New York.
Lawyers for New York Attorney General Letitia James are due to make oral arguments in U.S. District Court in Albany, and the timing couldn’t be worse for Sarcone.
Rulings in two similar cases in recent days – in which acting U.S. attorneys appointed by President Donald Trump’s administration were disqualified – suggest James has a good chance to prevail, according to two law professors familiar with the case.
James claims that Sarcone was improperly appointed to his post by U.S. Attorney General Pam Bondi after a panel of federal judges voted to remove him from the role in July.
