The Supreme Court of Canada has overturned a stay of drug charges in Hamilton and ordered two people to be retried in a case that has become a springboard for debate around the volume of cases being tossed for violating Charter time limits.
Sarah Josipovic and Robert Vrbanic — both from Grimsby — were charged in 2021 in connection with Project Skyfall , a massive drug and organized crime probe led by Hamilton police and the RCMP.
Court heard the project included 150 judicial authorizations (including two wire taps) and more than 70 gigabytes of evidence. In all there were 18 people charged, with the accused split into five prosecution groups.
Vrbanic had charges in two different groups. This included being charged in “group five” alongside Josipovic after police allegedly found $400,0
