CLEVELAND, Ohio (WOIO) - A federal judge on Tuesday issued an opinion and order when it comes to a lawsuit trying to stop the state from using unclaimed funds to support a new Browns stadium in Brook Park.
The order has a win for the state and a win for the former Ohio Attorney General Marc Dann, who filed to lawsuit to stop the use of funds.
The state asked the federal judge to throw out the lawsuit but that was denied by Judge Edmund Sargus, Jr. This means the lawsuit can continue.
Dann asked for an injunction and a restraining order to stop the payment from going to the Browns on Jan. 1. The judge denied that as well.
This means the lawsuit will move forward with the Browns guaranteed their funding.
