Mesa County District Attorney Dan Rubinstein (R), states, "The US Constitution says that the President has the authority to pardon people for crimes against the United States, which is interpreted as federal crimes that were brought in U.S. district court. These were crimes that were against the state of Colorado, and only the top executive of the state of Colorado has the authority to pardon that which is at the current time, Governor Polis."
