POTTSTOWN — The long-running legal dispute between the borough and a landlord and his tenants over whether borough officials can conduct a rental inspection of a property without the occupant’s permission has resulted in a loss for the borough.

The Commonwealth Court of Pennsylvania ruled that the borough’s practice of getting “administrative warrants” to inspect a rental home where the occupants have refused the borough entry violates the Pennsylvania Constitution.

The borough is evaluating whether to appeal the ruling to a higher court.

The case goes all the way back to 2017 , when landlord Steve Camburn and his tenants, Dottie and Omar Rivera, joined legal forces with the Institute for Justice , a Libertarian nonprofit law firm based in Virginia, after the Riveras refused permiss
