An Atlantic County Superior Court judge has refused to dismiss the indictment against Atlantic City's school superintendent accused of abusing her teenage daughter, according to court documents.

La'Quetta Small, 48, is charged with endangering the welfare of a child.

Michael Schreiber, Small's attorney, argued before Judge Bernard DeLury on April 15 that there should have been separate grand jury presentations because the circumstances surrounding his client are different from those of her husband, Mayor Marty Small Sr.

Mayor Small, 51, is also charged with terroristic threats, aggravated assault and witness tampering, while Superintendent Small is charged only with one count of endangering.
