MILFORD, Mass. (WLNE) — The Milford high school student who was detained by ICE agents while on his way to volleyball practice on May 31 was granted bail by an immigration judge Thursday.

The release comes a day after 18-year-old Marcelo Gomes da Silva’s family plead for his release in a video.

The judge said that the government had not met their burden of demonstrating the teen was a danger to the community.

ICE said that his father was the target of its investigation, but Gomes da Silva was also living in the country illegally and driving his father’s car, so he was taken into custody.

The judge did argue that Gomes da Silva was a “minor flight risk,” so granted $2,000 bond.
