Three pharmaceutical groups filed federal lawsuits against North Dakota’s recently passed 340B law, the North Dakota Monitor reported Aug. 26.  House Bill 1473 was signed into law by Gov. Kelly Armstrong earlier this year, making it a class B misdemeanor for drugmakers to impose policies that interfere with pharmacies dispensing medications on behalf of 340B-covered hospitals. 

The lawsuits were filed by AbbVie, Astrazeneca and Pharmaceutical Research and Manufacturers of America, an industry group. The plaintiffs argue that the new law violates the U.S. Constitution by infringing on federal authority and violating the Fifth Amendment by forcing companies to sell products to private parties.  North Dakota Attorney General Drew Wrigley, whose office is defending the law in court, told the
