MEMPHIS, Tenn. (WMC) - Judge Sheryl Lipman has granted a new trial for three of the now former Memphis police officers charged in the death of Tyre Nichols .
Lipman approved a request for new trials for Taddarius Bean, Demetrius Haley, and Justin Smith.
Emmitt Martin and Desmond Mills , who pleaded guilty, will not be included in the new trial.
Bean, Haley, Martin, Mills and Smith were all accused of federal civil rights violations in Tyre Nichols’ Jan. 7, 2023 traffic stop that would result in his death.
In October 2024 , Bean and Smith were found guilty of witness tampering. Haley was found guilty on four charges.
Sentencing had been delayed for the five after Judge Mark Norris, who presided over the case, recused himself suddenly. Lipman then took over the case.
