NELSON, Neb. (KSNB) - A judge is considering a new trial for a Superior man convicted of murdering his girlfriend and the legal argument involves new evidence from the victim’s cellphone.
On June 30, a Nuckolls County jury convicted 32-year-old Sebastian Dunbar of murder for the December 2023 shooting death of Molly Gruber.
Court documents show that the next day prosecutors told Dunbar’s attorney that they had obtained new evidence from Molly Gruber’s cell phone. Investigators had Gruber’s phone since her murder in 2023. But court documents show they had been unable to crack the phone until June 30, the day Dunbar was convicted.
Dunbar’s attorney then asked District Judge Morgan Farquhar for a new trial. On Thursday, Farquhar heard arguments on the case in Nuckolls County District Co
