SOUTH BURLINGTON, Vt. (WCAX) - A Vermont police officer accused of hitting and killing a bicyclist is now expected to take a plea deal in his criminal case, and it may not include any jail time.

Shelburne Police Sgt. Kyle Kapitanski has been on paid leave since the crash last November.

According to independent journalist Mike Donoghue, the state and Kapitanski have reached a plea deal that would reduce his felony charge to a misdemeanor.

WCAX has also independently confirmed the news.

Police say Kapitanski hit Sean Hayes, 38, while Hayes was riding his bike on Shelburne Road in South Burlington at about 3 a.m. on Nov. 11. Hayes was killed in the crash.
