NEWTON FALLS, Ohio (WKBN) - The U.S. Supreme Court will consider the merits of an appeal filed by Claudia Hoerig in connection with her conviction in the 2007 shooting death of her husband, Karl, inside their Newton Falls home.
The Court docketed Hoerig's case on Tuesday and will have a decision by January.
Hoerig has claimed several constitutional violations in her appeal, including a claim of "sudden passion." This is a legal claim stating an extreme emotional state of the offender during the commission of a crime, typically murder. Hoerig claims she was the victim of domestic abuse, which led to her killing her husband.
The high court doesn't rule on whether the claim of sudden passion is valid or not, but it will consider constitutional violations in connection with the claim. For i
