The Florida Supreme Court is set to hear a last-minute appeal from David Joseph Pittman, a man on death row since 1991, who claims he is intellectually disabled and therefore exempt from execution.

David Joseph Pittman, 54, is scheduled to be executed on September 17, 2025, after a lengthy legal battle spanning more than three decades. The Florida Supreme Court is currently considering a last-ditch appeal from Pittman’s lawyers, who argue that he is intellectually disabled and ineligible for the death penalty.

However, the State of Florida’s legal team contends that this claim is both untimely and without merit.

The execution warrant, signed by Governor Ron DeSantis on August 15, 2025, stems from Pittman’s 1991 conviction for the murders of three people in Polk County.
