SUN PRAIRIE, Wis. (WKOW) –- With the new vape ban law now in effect, many Wisconsin shops are staring at empty displays while weighing their next move.
The law requires the state Department of Revenue to fine sellers of vaping devices that lack Food and Drug Administration (FDA) authorization.
WiscoFAST, a Wisconsin trade organization, has filed a lawsuit against the Department of Revenue. The group argues the law unfairly encroaches on the FDA's role in regulating these products.
"The Wisconsin case is kind of a landmark case that is going to set a precedent for how the FDA and states combine to regulate vapes," said Tyler Hall, president of WiscoFAST.
