In a briefing filed Tuesday, Colorado Attorney General Phil Weiser reiterated the state’s claim that former Mesa County Clerk Tina Peters is ineligible for federal habeas corpus relief.
Peters, who is serving a nine-year sentence at the La Vista Correctional Facility in Pueblo, is seeking for a federal court to allow her to bond out of prison pending her appeal at the state level.
According to Tuesday’s briefing, Peters has not exhausted her options at the state level, which would preclude a federal court from getting involved.
Peters was convicted of three counts of attempting to influence a public servant, one count of conspiracy to commit criminal impersonation, one count of official misconduct and one count of failure to comply with the secretary of state, and sentenced to nine year
