HENDERSON, Ky. (WEHT) -- The man convicted in the killing of a Spencer County teen is appealing to the Indiana Supreme Court to stop his upcoming execution.
Attorneys for Roy Lee Ward are asking the court to re-hear a challenge to the execution method as well as asking for a stay of execution.
His execution is scheduled for October 10. Ward claims the state's last execution was botched when experts say the drugs used did not work as they should have.
He says he will be executed in a needlessly and intentionally painful manner in violation of the Eighth Amendment. The court has not responded to the appeal.
