WACO, Texas (KWTX) - The Texas Court of Criminal Appeals this week denied a major point of appeal in former Waco daycare owner Marian Fraser’s murder case, but sent portions of the case back to an intermediate appellate court in Amarillo for further review of two legal issues.

Fraser, 61, is serving a 50-year prison term after she was convicted a second time in the 2013 Benadryl overdose death of Clara Felton, an infant in her care who was the granddaughter of McLennan County Judge Scott Felton.

The circuitous case has bounced around for a dozen years between the trial court in Waco, the 7th Court of Appeals in Amarillo and the Texas Court of Criminal Appeals.
