DUBLIN, Ga. — A jury could not decide the guilt or innocence of a Dublin nurse accused of killing his wife back in 2021, forcing the judge to issue a mistrial and sending the trial back to square one.

Ben Whitaker was on trial in the death of his wife of just a 59 days at their Penn Avenue home.

The prosecution argued Whitaker killed his wife over her "nagging" him about his drinking. The defense, however, argued that his actions were inflamed by medication he was taking that his body couldn't process.

But after a two-week trial , a jury couldn't reach an unanimous verdict with only one juror holding out. It is unclear which direction the jury leaned.

After roughly 8 hours of deliberation, Judge Jon Helton issued a mistrial.
