PHOENIX — Arizona Superintendent of Public Instruction Tom Horne has filed a motion in the Arizona Supreme Court calling for Justice Bill Montgomery to recuse himself from an ongoing legal case.

This comes during an ongoing legal challenge against dual language instruction in Arizona schools.

Horne’s attorney says the superintendent has a bad past with Montgomery.

More than a decade ago, the justice, who was then in charge of the Maricopa County Attorney's Office at the time, accused Horne of violating state campaign finance laws.

Supt. Horne filed a three-page motion at the Arizona Supreme Court last week.
