A North Texas mom is taking a Dallas property owner to court after a tree crushed her car–and her, leaving her paralyzed.

According to a lawsuit filed in Dallas County on Monday, the Marsau family claims, “This tragedy was foreseeable and was the product of neglect. A dangerous, rotting tree was allowed to lean over a busy neighborhood roadway until it finally fell onto an unsuspecting young woman, whose life and whose family’s lives will never be the same.”

They say Marsau was driving along Wendover Road on August 25 when a tree fell from Dan Patterson’s property onto her car, trapping her inside.

The lawsuit indicates that the tree also hit a power line, causing wires to spark around her car, and preventing witnesses from being able to help her.
