LAS VEGAS ( FOX5 ) — A Nevada state senator is disputing a DUI charge after he was arrested Friday, saying he wasn’t drunk — just tired.

According to an arrest report, Edgar Flores was found near the intersection of Lamb and Lake Mead boulevards, slumped over in the driver’s seat and appearing to be asleep.

Flores, a Democrat representing District 2, was first elected in November 2022.

Another officer arrived to assist. That officer tried to wake Flores, which he eventually did, but Flores “appeared confused and disoriented, looking side to side without focus,” the report said.

In a statement, Flores said he had been tired after a long day of work, community events, evening exercise and a late dinner.
