Quebec court judge Bertrand St-Arnaud is slated to decide whether the Montreal mother accused of abandoned her three-year-old daughter should remain detained at the Philippe-Pinel psychiatric institute or be released with or without conditions.

The proceedings follow a decision handed down Monday that deemed 34-year-old mother not criminally responsible for the charges of criminal negligence and the unlawful abandonment of a child due to the presence of a mental illness.

The accused had been facing with a maximum sentence of 10 years for criminal negligence causing bodily harm and five years for the full penalty for the unlawful abandonment of a child.

The non-responsibility ruling followed a joint recommendation from both the Crown and defence after reviewing her psychiatric assessment
