MINOT, N.D. (KMOT) – The court set a scheduling conference for a man charged in the killing of an Air National Guardsman in Minot after a judge rejected a proposed plea deal in the case.
Daniel Breijo, of Surrey, faces a murder charge for the death of Nicholas Van Pelt in a Christmas Eve 2023 shooting at a northwest Minot apartment. He’s also charged with aggravated assault for the injuries suffered by Jenni Babcock in the shooting.
Earlier this month, the state and defense presented a plea agreement to the court that called for Breijo to plead guilty to manslaughter in Van Pelt’s death, but Judge Daniel El-Dweek refused to accept the deal and ordered it remain on the trial calendar.
A jury trial remains scheduled for Oct. 6, though that may be pushed back.
