The city of Henryetta has agreed to temporarily halt prosecutions of tribal members for traffic violations after a judge declined to postpone a hearing on the matter.

The move comes after the Muscogee Nation asked a federal judge earlier this summer to order the city to stop prosecuting tribal members in its municipal court, claiming it violates the tribe’s sovereignty.

In July, the nation sued the city of Henryetta claiming police were ticketing tribal members in violation of federal law.

The nation cites the U.S. Supreme Court’s 2020 McGirt ruling, which determined that Congress had never disestablished the tribe’s reservation, and federal law, which grants criminal jurisdiction over tribal members to the tribe and federal government. The Muscogee
