The Trump administration on Friday asked the Supreme Court to block a lower court ruling that lets transgender and nonbinary people choose the gender marker on their passports.
The ruling allows applicants to request male, female or an "X" designation, rather than being limited to the sex listed on their birth certificate.
The Justice Department argued the government should not be required to use markers it considers inaccurate on official documents. The decision stemmed from a lawsuit challenging Trump's executive order requiring passport applicants to use the gender from their birth certificate.
