MADISON, Wis. (WKOW) – A national conversation about the First Amendment has been sparked by the FCC chair's comments toward ABC and ABC's decision to take Jimmy Kimmel off the air.

WKOW discussed the issue with Anuj Desai, a Volkman-Bascom Professor of Law and First Amendment expert at UW-Madison's Law School.

Desai emphasized that nearly all forms of speech, including hate speech, are protected by the First Amendment.

"The First Amendment only prohibits actions by the government," Desai said. "So, generally speaking, if you are employed by a private employer, as Jimmy Kimmel was -- or is -- it does not regulate the relations between your employer and you."

Desai also said that the FCC's pressure on ABC to suspend Kimmel is unprecedented.
