In his 12 years of working for the Colorado Freedom of Information Coalition, Jeff Roberts has found that probably the most commonly misunderstood provision in the state’s open records law that he has seen is the personnel file exemption.
The exemption is often not interpreted correctly by public institutions and governments, Roberts said, and it often takes a letter from a lawyer to show the entity how it should be applied.
The Daily Camera requested records related to the job performance of the dean of the University of Colorado Law School in 2024 and in June of this year. Both were denied, citing the personnel exemption under the Colorado Open Records Act.
