LANSING — A handful of new developments emerged last week in the legal battles over Enbridge’s Line 5 oil pipeline.
Those cases could impact the pipeline’s current function and the proposed tunnel project, with challenges from the state and federal levels potentially moving closer to a ruling.
The Michigan Supreme Court agreed last week to hear two challenges to the Line 5 tunnel’s 2023 approval by the Michigan Public Service Commission, or MPSC.
“This case is really focused on sort of the principles of the Michigan Environmental Protection Act and whether or not the commission properly upheld its duty under that statute,” said Adam Ratchenski, senior associate attorney for Earthjustice.
