BROOKFORD, N.C. — A police chief has filed a motion to dismiss criminal charges against him related to his investigation of a decades-old murder case, claiming prosecutors lack probable cause and engaged in retaliation.

Police Chief Willie Armstrong faces charges stemming from an indictment connected to the Dee Dee Dawkins cold case. According to a search warrant, a person of interest alleges Armstrong intentionally left his phone in their home to secretly record them.

Armstrong maintains the incident was accidental and denies any criminal intent.

"We walk out of the house, phone still sitting on the table. It was an accident, I never had a criminal intent to do anything wrong," Armstrong said in an earlier interview.
