BOISE, Idaho — A legal advocacy group announced on Tuesday it will defend Idaho's new school choice tax credit program against a lawsuit challenging its constitutionality .
The Partnership for Educational Choice , a joint project of the Institute for Justice (IJ) and EdChoice, filed to intervene in a lawsuit brought by the Idaho Education Association and other groups against the Idaho Parental Choice Tax Credit program .
The "Idaho Parental Choice Tax Credit," or House Bill 93 , was signed into law by Idaho Gov. Brad Little on Feb. 27, 2025. Under HB93, families would receive up to $5,000 per student for eligible education expenses, including private school tuition. That number jumps to $7,500 for students with disabilities.
