**Willie Mitchell Named in Civil Lawsuit Alleging Sexual Assault** Former NHL player Willie Mitchell is facing a civil lawsuit that alleges he sexually assaulted a woman at his home in Tofino, British Columbia, in 2022. The lawsuit, filed in B.C. Supreme Court, identifies the plaintiff as S.D.K., a 26-year-old woman who worked as a server at the Tofino Resort at the time of the incident. The claim states that on September 11, 2022, after completing her shift at the 1909 Kitchen and Bar, S.D.K. consumed several alcoholic drinks at The Hatch, a pub connected to the resort. According to the lawsuit, she became visibly intoxicated and has limited recollection of the events that followed. The lawsuit alleges that Mitchell, who was acting general manager and one of the directors of the Tofino Resort, escorted S.D.K. out of the pub and drove her to his residence. It claims that while at his home, Mitchell engaged in sexual activity with her without her consent, taking advantage of her impaired state. The lawsuit states, "Mitchell took the plaintiff to his private residence. While at Mitchell's residence, in an altered level of consciousness secondary to her extreme intoxication, and without her express or implied consent, Mitchell engaged in unprotected sexual activity with the plaintiff." S.D.K. reported the incident to local police the following day and underwent a forensic examination at Tofino General Hospital. The police investigated the matter and submitted a report to B.C. prosecutors, who ultimately decided not to pursue criminal charges. A spokesperson for the B.C. Prosecution Service stated that the evidence did not meet the necessary standard for prosecution. The lawsuit also claims that Mitchell had a duty of care as an agent of the resort to ensure that S.D.K. was not overserved alcohol and was protected from foreseeable harm. S.D.K. is seeking damages for physical and mental injuries, including loss of self-worth and difficulties in personal relationships. Additionally, the lawsuit alleges that Mitchell and the resort were negligent in their responsibilities, stating, "Mitchell … had a duty to ensure the plaintiff was not overserved to the point of severe intoxication and to take reasonable steps to protect the plaintiff from foreseeable harm including her vulnerability to the sexual assault." S.D.K. has requested that her full name be kept confidential in court documents to protect her privacy, despite acknowledging that her identity is known in the small community of Tofino. Willie Mitchell, 48, is a former professional hockey player who played 15 seasons in the NHL, including four with the Vancouver Canucks. He won two Stanley Cups with the Los Angeles Kings in 2012 and 2014 and retired from professional hockey in 2016. Mitchell is no longer a director of the Tofino Resort, having stepped down in 2023. None of the allegations in the civil lawsuit have been proven in court, and the defendants have not yet filed statements of defense.
