PORTLAND, Ore. (KOIN) – The Department of Justice has suggested a judge recuse himself from a court case that will determine the legality of the Trump Administration’s decision to send the Oregon National Guard into Portland.
According to court documents filed Thursday, the current judge assigned to this case, Judge Michael H. Simon, has a conflict of interest and therefore cannot make a fair decision.
On Monday, Oregon AG Dan Rayfield -- with the support of Gov. Tina Kotek and Portland Mayor Keith Wilson -- filed a motion for a temporary restraining order against the federal troops in Portland. The suit claims that the decision was “unlawful” and poses a “substantial risk” to its residents.
