New York has become a national leader in gaming regulation, with some of the strictest standards in the country. The Gaming Commission has some of the strictest licensing and consumer safeguards in the nation since mobile sports betting began in 2022.

Through this oversight, New York has built a framework that puts consumers first, ensures fair play, and gives back to its communities.

But that progress is at risk. Prediction market platforms like Kalshi have been trying to bypass state gambling laws by cloaking its gambling operations in the language of finance. These companies have argued that its business –permitting wagers on real-world events including sporting contests – falls under federal oversight by the Commodity Futures Trading Commission (CFTC), rather than state authorities
