The maximum manslaughter sentence for a youth is three years

The prosecution will not seek an adult sentence for a Calgary youth convicted of manslaughter in the fatal stabbing of a city teen, court heard Monday.

Instead, Crown lawyer Vicki Faulkner said she will be asking Justice Eleanor Funk to hand the offender the maximum youth sentence of two years custody, on top of the more than 24 months he has already served.

Under the Youth Criminal Justice Act, the maximum sentence for manslaughter is three years, a combination of two in detention and a year under supervision in the community.

But the federal act does not require judges to give offenders credit for pre-sentencing custody.
