OMAHA, Neb. —

Nebraska Attorney General Mike Hilgers is filing a lawsuit against the Omaha Public Power District for its plan to transition a plant from coal to natural gas.

OPPD is planning to move away from using coal at the North Omaha Coal Plant and will be using natural gas by 2026.

"We're getting them to that level of planning of converting the plant from a coal-burning, power generation plant to a natural gas burning power generation plant," Javier Fernandez, OPPD CEO, said in August 2024 .

The attorney general said the plan contradicts the core mission of public power established by the Nebraska Legislature. According to Hilgers, OPPD's proposal will threaten grid reliability and "create conditions where OPPD ratepayers will likely be subjected to higher costs."
