PORTLAND Ore. (KPTV) - A federal appeals court could rule at any time on whether to block or allow National Guard troops to deploy in Portland, following an emergency hearing Thursday morning that left both sides waiting for answers.
The legal battle over the federalization and deployment of troops to Portland escalated to the Ninth U.S. Circuit Court of Appeals after the Trump administration quickly appealed a federal judge’s decision last weekend to block the troop deployment through a temporary restraining order.
At the core of Thursday’s hearing was a question of how much deference the president receives when federalizing the National Guard under U.S. Code 12406.
