The attorney for Harmony Montgomery’s mother filed two motions Tuesday to get a wrongful-death lawsuit against Adam Montgomery back in court after he said a judge erroneously dismissed the case late last week.

Kevin Leonard, the attorney for Crystal Sorey, said a court error led to Hillsborough County Superior Court Judge Michael Klass dismissing the lawsuit , but all the paperwork was served in a timely manner. In an order Friday, Klass wrote that “The Plaintiff has not filed the return of service with the Court or sought to have the deadline for service extended.”

Leonard said the lawsuit and affidavit were filed on Sept. 15 for the suit against Montgomery, a 35-year-old former Manchester resident who was convicted of beating his 5-year-old daughter, Harmony, to death on Dec. 7, 2019
