A judge has dismissed a lawsuit filed against Rose Hills Memorial Park & Mortuary by the widow and other relatives of a man who died of cancer in 2022 and allegedly was not dressed according to Buddhist tradition as requested by the family before his cremation.

Joann Chen — the widow of the late Mike Chen — her two sons and two grandchildren brought the negligence suit in Los Angeles Superior Court. On Tuesday, Judge Lisa R. Jaskol dismissed the case after no one from either side showed up for the scheduled start of the trial. The judge’s ruling was “without prejudice,” leaving the door open for the lawsuit to be possibly reinstated.

In their previous court papers, Rose Hills attorneys contended that the mortuary received poor communications from the Chen family.
