The family of a Washington Heights man fatally shot by a police officer during a Bronx traffic stop in 2019 is suing the NYPD and its commissioner Commissioner Jessica Tisch.

The lawsuit looks to overturn Tisch decision two months ago that overruled a judge’s recommendation to fire Lt. Jonathan Rivera.

In a departmental trial, NYPD Judge Rosemarie Maldonado found that Rivera was not justified in shooting 31-year-old Allan Feliz as he tried to flee the stop, initially made over an allegedly undone seatbelt. Maldonado sided with the Civilian Complaint Review Board, the city's police watchdog body.

But Tisch, who had the final say, concluded that Rivera acted reasonably, fearing that Feliz would injure other officers as they struggled in the vehicle. New York Attorney General Letitia J
