The Edmonton Police Service’s (EPS) head lawyer recently faced a barrage of questions from Canada’s top court over the service’s bid to withhold certain officer misconduct files in criminal cases.

The Supreme Court heard arguments earlier this month in the case of John McKee , who is asking EPS to turn over disciplinary records for Det. Jared Ruecker, the officer who investigated him for drug and weapons offences.

Police services typically disclose the records of investigating officers to the Crown, which decides whether they’re relevant to an accused’s right to defend themselves.

EPS, however, says the 2015 case involving Ruecker has been “expunged” under the provincial Police Act and shouldn’t be a part of the information given to McKee. Disclosing such records would ignore the pri
