RED WILLOW, Neb. —

A judge has overruled and denied a motion to dismiss a lawsuit against the Immigration and Customs Enforcement detention facility in Nebraska, according to court documents.

Thirteen McCook residents and a former state senator filed the lawsuit against Nebraska Gov. Jim Pillen and Rob Jeffreys, the head of the Nebraska Department of Corrections.

The judge also overruled a temporary injunction seeking to block the Work Ethic Camp in McCook from housing detainees, court documents state. The case will continue.

Part of the lawsuit alleges Pillen does not have the right to repurpose the Work Ethic Camp without approval from the Legislature.
