A man accused of stealing nearly $22,000 from a local American Legion post has waived his preliminary hearing, allowing the case to move forward in county court, police announced in an updated release on Monday, Oct. 27.
Michael David Klein, 49, of Leaman Street in Lititz, faces two counts of Theft by Failure to Make Required Disposition of Funds Received after allegedly pocketing $21,942 while serving as treasurer and finance officer for the Sons of the American Legion Post 56.
Alleged Scheme Unfolded Over 14 Months
Klein took over financial responsibilities for the post in February 2024. According to police, the organization raised $41,680 through fundraising efforts by April 2025—but less than half of those proceeds ever made it into the group’s account. Investigators say Klein was the only person authorized to deposit the funds.
Authorities allege that in December 2024, Klein also wrote himself an unauthorized $1,500 check from the Legion’s bank account.
Legion leaders became suspicious after noticing unpaid bills and missing donations. Multiple members told police they discovered false, misleading financial reports submitted by Klein. After being confronted internally, Klein allegedly sent a written apology and offered restitution.
When questioned by Lititz Borough Police on June 26, Klein admitted to taking the money, the criminal complaint states.
Legal Proceedings & Status
Klein waived his preliminary hearing before Magisterial District Judge Joseph Stauffer on Oct. 6. He remains free on $35,000 unsecured bail.
The investigation was led by Lititz Borough Police Sgt. Stephen Detz. The charges are now pending in Lancaster County Court.
