A former Sununu Youth Services Center worker will not have to face a second trial on accusations of sexual abuse after the alleged victim told prosecutor he did not want to continue with the criminal case.
The Attorney General’s Office filed a “notice of nolle prosequi” last week, which puts an end to the prosecution of Jonathan Brand on a single charge of felonious sexual assault. Such a notice does not need to be approved by a judge, and the door is left open for future prosecution.
Brand’s attorney, John Newman, declined comment on Tuesday afternoon.
A jury in a different case had found Brand, 61, of Concord, not guilty of two counts of felonious sexual assault after a trial that lasted three days last month.
